It's not really worth arguing, but yes, it's more ethical to play at the lowest level of a bracket rather than to abuse a bug to bypass the developer's attempt at separating the XP on and XP off brackets (a.k.a exploiting) . They separated it for a reason. If the devs wanted to throw unsubbed accounts into the XP off bracket, they could have, but they didn't. You are knowingly abusing a bug to bypass developers' intentions.
