Can this scope be applied on a lower level weapon?

If your target weapon at 39 is ilvl 50+ it could probably work, since the +7 scope works for 29's on the masterhunter weapon rewards from STV which are 45 ilvl (applied through the trade window by a 40+ character).

Sorry I don't know for sure about biznicks, but likely if it's not ilvl 50+ it will be "too low level". Hope someone knows.

edit- I don't see any quest ranged for 39 that high ilvl on wowhead anyway, so my guess would be no.
