Cata epics are unobtainable for f2ps afaik. After that gems are primarily secondary stats, so you are left with TBC/Wrath gems or occasionally pvp vendor gems if the right combination for you is being sold.

The main change is that the single stat WTLK gems are no longer scaling to 3 in bgs. TBC does scale as before (to 3). Everything else is consistently scaling to 2/2 and 3. Nightmare tear gives 3 all stats both outside (lvl20) and in a battleground (lvl 29).

If you only have high lvl char + your 20, they will both get an item every boss. We tried with a third char (another 20) and the drop rate was not 100% anymore.

Ahm, all of those are bind on pickup boss drop. Keeping them for years or days does not make a difference.

"unique item" means literally a unique entity. "nothing is unique about them" means they are not different in a meaningful way (outside your head) and there is no reason for them not obey to the scaling rules for other green items. Do I really need to explain everything like we are 15 again?
